Terms of Service

By accessing or using HeatSync (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, whether as a registered account holder or as a guest.

HeatSync is a water heater diagnostic platform designed for HVAC and plumbing professionals. The Service provides guided troubleshooting flows, error-code lookup, and job-management tools for tankless and tank-style water heater systems.

The information provided through the Service is for informational and professional-assistance purposes only. It does not replace manufacturer service manuals, local codes, or the judgment of a licensed technician. Always follow applicable safety regulations when working on live equipment.

To access certain features you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when registering, and to update your information promptly if it changes.

You must be at least 18 years old to create an account. By creating an account you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that violate these Terms.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• removeReproduce, distribute, or create derivative works from the Service content without our written permission.
• removeReverse-engineer, decompile, or attempt to extract source code from the Service.
• removeUse automated means (bots, scrapers, crawlers) to access the Service without prior written consent.
• removeUpload or transmit viruses, malware, or any code of a destructive nature.
• removeImpersonate any person or entity, or misrepresent your affiliation with a person or entity.
• removeAttempt to gain unauthorized access to any part of the Service or its related systems.
• removeUse the Service to send unsolicited communications or spam.

The Service and its original content, features, and functionality are and will remain the exclusive property of HeatSync and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Diagnostic flows, error-code databases, and related technical content are proprietary to HeatSync. Brand names referenced in the Service (Rheem, Navien, A.O. Smith, Rinnai, Bradford White, etc.) are the property of their respective owners and are used for identification purposes only.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any diagnostic result or information provided through the Service.

Technical troubleshooting guidance is provided in good faith but may not account for all variables specific to your equipment, installation, or local codes. The final determination of any repair or service action rests with the qualified technician on site.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEATSYNC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

You agree to defend, indemnify, and hold harmless HeatSync and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date at the top of this page and, where appropriate, by sending a notice to the email address associated with your account.

Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
